ARTICLE 1: SCOPE OF APPLICATION

The purpose of these “General Terms and Conditions of Use” (hereinafter referred to as “GTCU”) is to provide a legal framework for the use of the https://www.gtwestafrica.com website and its associated application (“the Platform” will refer jointly to the website and the mobile application).

They apply to any person (hereinafter referred to as the “User”) using or visiting the Platform.

This contract is concluded between the manager of the Platform, hereinafter referred to as the “Publisher”, and the User.

Access to the site implies acceptance of these terms of use. The Publisher reserves the right to modify the GCU at any time, but only the provisions in force at the time of use of the Platform will be applied.

ARTICLE 3: CONDITIONS OF ACCESS TO SERVICES

The Platform allows the User to become a member and join the investment club initiated by Gt West Africa, which finances revenue-generating machines through the opening of prize pools.

The Platform also offers the possibility of estimating the revenues that can be generated according to the investment made and proposed by the club.

To invest via the Platform, the User must first create a personal customer account. Once created, to access it, the Customer must log in using his login and password.

His personal account will allow him to find :

  • Club recommendations
  • Characteristics of the financed machine
  • Payment history
  • Gear activity report

The Platform is accessible free of charge from anywhere and by any user with Internet access. All costs necessary for access to the services (computer hardware, Internet connection, etc.) are at the User’s expense.

Access to the Platform and its services may be interrupted or suspended by the publisher for maintenance or any other reason without prior notice.

ARTICLE 4: USER RESPONSIBILITY

The User assumes full responsibility for the use he makes of the information and content present on the site and the application.

Users are required not to disrupt the proper operation of the mobile application or the internal site, failing which they will be prosecuted.

The User undertakes to maintain the confidentiality of the login and password enabling him to access his customer account.

When registering, the User undertakes to provide true, accurate and up-to-date information at the time it is entered on the service’s registration form.

He or she must also keep the data supplied up to date, so as to guarantee that it is real and accurate at all times.

ARTICLE 5: PUBLISHER'S LIABILITY

The Publisher cannot be held liable for any server or network malfunction.

The Publisher accepts no responsibility for any viruses that may infect the User’s computer equipment after using or accessing the Platform.

Similarly, the Publisher cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

The Publisher also undertakes to use all necessary means to guarantee the security and confidentiality of data.

The Editor reserves the right not to guarantee the reliability of the sources, although the information published on the site and the application is deemed reliable.

The Publisher also reserves the right to hold the user civilly and/or criminally liable, in particular in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.).

Pursuant to the General Data Protection Regulation (RGPD), it is reminded that the personal data requested from the User is necessary for the processing of his/her request, the management of pre-contractual and contractual relations, the administration of the Platform and traffic analysis.

This data may be accessible to the Publisher’s service providers responsible for managing the website and application.

In accordance with European regulations, the User has the right to access, delete, rectify, port, limit and object to the processing of information concerning him or her.

This right may be exercised in accordance with the terms and conditions set out on the www.gtwestafrica.com website.

ARTICLE 9: CONTRACT DURATION

The duration of this contract is indefinite. The contract is effective for the User from the moment of acceptance of these GCU.

ARTICLE 10: APPLICABLE LAW AND JURISDICTION

This contract is governed by the laws of the United Arab Emirates, subject to the mandatory rules of the User’s country of residence.

In the event of a dispute between the User and the Publisher that cannot be resolved amicably, the courts of ordinary jurisdiction shall have jurisdiction to settle any dispute.
